GENERAL WARRANTY TERMS
I. General warranty conditions
- Bilberry Sp. z o.o., located at Brukowa Street 12, 91-341 Łódź, KRS 0000710242, hereinafter referred to as the "Guarantor," hereby provides a warranty for lighting products, under the terms described in this document.
- The guarantor declares that the above products are free from production and material defects, and if used for their intended purpose, they will function properly for a period not shorter than the duration of the granted warranty protection, subject to the cases described in this document.
- For all Bilberry products: lighting fixtures, light intensity sensors, motion sensors, and the control unit, the guarantor provides a 5-year warranty, unless stated otherwise in the catalog card.
- The warranty is valid only under the following conditions:
- The warranty covers only manufacturing defects and defects arising from causes inherent in the goods, i.e., hidden defects resulting from manufacturing defects or hidden material defects;
- Lighting fixtures should be operated in accordance with the information contained in the catalog sheet;
- The fixture should not be used in environmental conditions that pose a threat to the structure and electrical equipment installed in the lighting fixture. These conditions include the presence of non-neutral chemical substances in the air, as well as shocks and vibrations;
- If the conditions in which the fixtures are to operate differ from the conditions for which the fixtures are intended, and the Buyer has reported the conditions at the installation site to the Guarantor before making the purchase, and the Guarantor has confirmed the possibility of their use in such an environment;
- The use of products occurs in accordance with their intended purpose and the provided product specifications (catalog sheet);
- The installation of the products was carried out professionally by authorized personnel, according to the conditions specified in the catalog sheet and in accordance with the art and technical knowledge;
- The modification of product functions or software updates is carried out solely by the manufacturer of the fixtures or a third party designated by them;
- All repairs or maintenance of the products were carried out using professional knowledge and according to the manufacturer's recommendations;
- Products were not subjected to mechanical and/or chemical overloads that are inconsistent with their intended use, which could threaten the structure of the fixture, the paint coating, or the electronic components located inside the fixture;
- The ambient temperatures and supply voltage did not exceed the rated values specified for the products in the specifications or technical standards.
- Violation of the above and other rules mentioned in this document results in the loss of rights granted by the warranty.
II. Scope of Warranty
- The warranty begins from the date of purchase of the product by the Buyer, as indicated on the VAT invoice confirming the purchase of the goods.
- The Buyer's rights under the warranty for defects, as mentioned in the civil code, are excluded. This provision also applies to software.
- This warranty covers only defects in products resulting from design, material, or manufacturing errors.
- The warranty does not cover defects resulting from the effects of chemical, thermal, mechanical, light, and other factors, whose impact on the products is contrary to the operating instructions and technical knowledge;
- The parameters of the new LED fixtures (modules) are subject to a tolerance of +/-10% for luminous flux, power, and color temperature.
III. Warranty Claim
- The buyer submitting a complaint is obliged to promptly report the claim to the Guarantor.
- The warranty claim is submitted to the Guarantor, under the penalty of losing rights arising from the warranty, in writing to the address of the Guarantor's headquarters or by email to: info@bilberry.pl or the email address of the sales representative who sold the products covered by the warranty. The email must include proof of purchase of the product (VAT invoice or a copy of the purchase agreement) and a detailed, documented description of the defect that has occurred. Upon receiving the claim, the Buyer will be sent a message confirming the acceptance of the claim along with the provided complaint number.
- The Guarantor considers the claim within 14 days from the date of delivery of the defective goods and the documents specified in point 3.2., with the reservation of the possibility of extending this period in the event that detailed technical examinations are necessary, of which the Guarantor promptly informs the Buyer.
- The Buyer returns the defective goods referred to in point 3.3 of these General Terms and Conditions, with a clear indication on the shipment of the complaint number received from the Guarantor.
- Upon consideration of the application, the Guarantor informs the applicant in writing or via email.
- The Guarantor's liability is limited to the value of the product at the time of purchase.
- In the event of a warranty claim being accepted, the Guarantor shall decide on a case-by-case basis whether to repair the defective product, replace it with a defect-free product, reduce its price, or exchange it for a product with the same application and similar technical parameters, in the event that the product subject to the complaint has been withdrawn from the offer.
- The guarantor, when repairing a defective product, allows for the replacement of components with used or refurbished ones that are equivalent in terms of performance, functionality, and reliability to new components and are free from defects and material shortages.
- During the warranty process, the repair of the product or its replacement with a defect-free product is carried out free of charge.
- If, as a result of the acceptance of the claim, any components in the defective product are replaced, the warranty does not restart.
- If the complaint is accepted, the Guarantor will take the necessary actions to fulfill the warranty obligation no later than 21 days from the date of informing the Buyer about the method of handling the complaint, unless circumstances beyond the Guarantor's control arise that may affect the extension of this deadline, such as: the need to conduct additional laboratory tests, ordering non-standard components that will be used in the repaired fixture and require sourcing from suppliers, etc.
- If the product is not picked up after the Guarantor's call, the Buyer is responsible for the cost of storing the product, and possibly the cost of returning it.
- The storage period for the product by the Guarantor is a maximum of 6 months. After this period, the product will be returned to the Buyer at their expense.
- All costs related to the consideration of an unjustified warranty claim by the Guarantor shall be borne by the Buyer.
IV. Other conditions
- If the Buyer or any third parties designated by them make any interventions in the frame, repairs, changes, or removal of defects in the products without the written consent of the Guarantor, all claims under this warranty shall expire at the moment such actions are taken.
- The warranty also expires if the products were used or operated contrary to their intended purpose.
- In the event of receiving a complaint notification from the Buyer, the Guarantor reserves the right to inspect the defects of the claimed products at their place of use. The Buyer's lack of consent for such an inspection by the Guarantor or a representative designated by them is considered a withdrawal from the warranty claim.
- The Guarantor allows for the possibility of performing paid service repairs on products, including post-warranty repairs, the terms of which will be determined each time between the Buyer and the Guarantor.
- Bilberry Sp. z o.o., within the limits of applicable laws, is not liable for any losses, damages, increased costs or expenses, for the loss of ability to use the product, its functionality, for product damage, for any lost profits, savings, contracts, revenues, or for any losses or additional costs not resulting from the direct fault of Bilberry Sp. z o.o.
- The law applicable to this guarantee is Polish law.
- These General Warranty Conditions are effective from November 5, 2020, and apply to all orders placed after this date.
